Ted Forbes / Forbes Studio, LLC operates this website to provide online access to information about educational photography workshops and experiences (“Experiences”) and related products and services that we provide.

By accessing and using this site, you agree to each of the terms and conditions set forth.

Ted Forbes / Forbes Studio, LLC reserves the right to modify these terms at any time without giving you prior notice. Your use of the site following any such modification constitutes your agreement to follow and be bound by the modifications.

RESPONSIBILITY

Ted Forbes / Forbes Studio, LLC will provide Experiences as presented and outlined via this website and via The Art of Photography YouTube channel.

At times, Ted Forbes / Forbes Studio, LLC may partner with accomplished artists, photographers, publishers, and/or hospitality professionals to organize, lead, or administer aspects of these Experiences. Any of these designated individuals, their company/business, employees, affiliates, and representatives acts only as an agent for their entity, service, or specialty content. They are solely responsible and liable for providing their respective services.

Ted Forbes / Forbes Studio, LLC and the individuals aforementioned will not be held liable for any of the following:

Any injury, illness, or death
Any loss or damage to property
Any travel or other cancellation fees
Any acts of God–fire, flood, war, earthquake, tsunami, terrorism, epidemic, etc. beyond our control

By registering for an Experience, you certify that you do not have any mental, physical, or other condition that would create a hazard to yourself or to other Experience participants. Ted Forbes / Forbes Studio, LLC reserves the right in their sole discretion to accept, decline to accept, or remove you or any participant during/on an Experience.

IN-PERSON WORKSHOPS & EXPERIENCES

Eligibility
Anyone under age 18 must be accompanied by a parent or guardian for the entire Experience.

In-Person Experience Fees/Tuition Notes
All prices are per person, unless otherwise noted and will be listed in U.S. dollars.

Included in In-Person Experience Tuition
This may vary per Experience - see specific sales page for each Experience. Meals as indicated in the itinerary, educational materials, pre/post Experience information and online sessions, entrance fees, special events as included in the itinerary, domestic transportation on international Experiences, instructors and special guests/artists/models. Accommodations are also covered on International Experiences.

Not Included in In-Person Experience Tuition
This may vary per Experience - see specific sales page for each Experience. Air transportation, airport transfers to/from, gratuities, meals as indicated in the itinerary, passport / visa expenses, medical expenses and insurance, immunizations, laundry, telephone, personal expenses, and any other items not specifically noted as included.

Health Requirements
Ted Forbes / Forbes Studio, LLC reasonably accommodates travelers with disabilities for in-person Experiences, but not all trips may be suitable for all travelers. Any physical condition, diet, or treatment requiring special attention must be reported when you register. Walking and climbing stairs are required in many scenarios for in-person Experiences. If the participant requires a slower pace, extra assistance, or the use of a cane/walking stick, special arrangements may be necessary and can be made. This will be determined by Forbes Studio, LLC staff. This may result in extra costs. Ted Forbes / Forbes Studio, LLC encourages you to consult with a doctor about any advice regarding activities or select destinations.

You may forgo some scheduled itinerary components or details in order to relax and recover. You may do this at your discretion.

Medical Authorization and Coverage
You will be asked to submit information regarding an Emergency Contact in the event that you become injured during an Experience. In the event you become sufficiently incapacitated as to be unable to direct your own care, there is no one on the Experience who can direct your care, and Ted Forbes / Forbes Studio, LLC is unable or does not have time to contact your emergency contact, you authorize, by registering and paying a deposit for an Experience, any medical treatment deemed necessary in the event of any injury or illness while participating in the activity including, but not limited to, X-ray, examination, anesthetic, medical or surgical diagnosis, or treatment and hospital care which is deemed advisable by, and is to be rendered under the general or specific supervision of, any physician and/or surgeon licensed to render the necessary care. In addition, you certify that you have medical insurance which will cover personal accidents, medical expenses, medical evacuation, air ambulance, loss of effects, repatriation costs and all other expenses which might arise as a result of loss, damage, injury, delay or inconvenience occurring to you, or that in the absence of this medical insurance coverage, you agree to pay all costs of rescue and/or medical services as may be incurred on your behalf.

Travel medical insurance is HIGHLY ENCOURAGED.

Payments, Cancellations, and Refunds
In-Person Experience fees/tuition require a deposit that is approximately 20% of the total tuition. Specific deposit requirements will be listed on the sales page for each Experience. You will always have the option to pay the deposit then opt into a payment schedule of 1-2 installment payments depending on the total tuition. Dates for installments will be listed on the sales page for each Experience. Ted Forbes / Forbes Studio, LLC will invoice you for each installment payment. You will receive the invoice one week in advance of the due date. If you fail to make payment in a timely fashion, you risk being removed from the Experience roster.

Cancellation policies may vary depending on the duration and depth of the Experience. Specific cancellation policies will be listed on the sales page for each Experience. This information will also be shared with you following registration.

If you register for an Experience that involves travel to a specific location, airfare, baggage, and personal effects are at all times your sole responsibility. Ted Forbes / Forbes Studio, LLC will not be liable for any of these travel details and items.

Trip cancellation insurance is HIGHLY ENCOURAGED.

Should Ted Forbes / Forbes Studio, LLC need to cancel an Experience for any reason, your payment will be refunded fully.

Itinerary Changes
Ted Forbes / Forbes Studio, LLC reserves the right, without penalty, to make changes to the published schedule and/or itinerary, whenever the conditions warrant or if the change is deemed necessary for the comfort and safety of Experience participants.

ONLINE WORKSHOPS & EXPERIENCES

Internet Connectivity
You are responsible for securing proper internet access to attend sessions. Ted Forbes / Forbes Studio, LLC will not be held responsible for issues with connectivity on your end, or for user error on your part.

We use Zoom for online Experiences. You may access a free account via zoom.com. You are responsible for securing an account and learning to use the Zoom platform.

Ted Forbes / Forbes Studio, LLC will not be held responsible for problems stemming from third party vendors such as Zoom. If a session has to be stopped due to unforeseen circumstances, it will be rescheduled at another time and refunds will not be issued under such circumstances.

Payments, Cancellations, and Refunds
Online Experience fees/tuition are due in full at time of registration. Cancellation policies may vary depending on the duration and depth of the Experience. Specific cancellation policies will be listed on the sales page for each Experience. This information will also be shared with you following registration. If a cancellation is necessary, we will make every effort to transfer your tuition to another online Experience.

Should Ted Forbes / Forbes Studio, LLC need to cancel an Experience for any reason, your payment will be refunded fully.

Schedule Changes
Ted Forbes / Forbes Studio, LLC reserves the right, without penalty, to make changes to the published Experience schedule, whenever the conditions warrant or if the change is deemed necessary for the comfort and safety of Experience participants.

Photography and Video Recordings
Ted Forbes / Forbes Studio, LLC reserves the right to take photographs and/or videos during an Experience and to use these images/videos for educational and promotional use. You will have the opportunity during registration to decline the use of your likeness. When you agree to the use of your likeness by Ted Forbes / Forbes Studio, LLC, you also agree to no compensation.

Note: video recordings of online Experiences are solely used and made available to registered participants of that Experience.

Copyright in all photographs, video, and related materials created by you during an Experience will belong to you upon creation.

TedForbes.com and the content on this website are protected by the U.S. and/or international copyright laws, and belong to Ted Forbes / Forbes Studio, LLC. You may download and reprint content for educational and personal use only. You may not modify, copy, reproduce, republish, upload, post, transmit or distribute in any manner the material on this website, including photographs, text, graphics, and/or code for any purposes other than your own personal use. Printing or downloading the material does not transfer title to the material, or any intellectual property rights. You can’t resell or redistribute any material from this website.
